UnBelievable! A Judge Actually Ruled That Machine Gun Bans Are Unconstitutional!

Oh you know this is going to be appealed all the way to the Supreme Court but the fact that a judge actually ruled the ban Unconstitutional under the 2nd Amendment has to have the ATF and every Gun Grabber in the country absolutely shitting rings around themselves!

  1. That certainly is interesting. Makes me wonder what the gov will come up with in response.

    Most people really misunderstand Miller. The Supreme Court did not make much of a decision re. NFA. The dicta in the case are a wonderful source of education re. firearms laws in the U.S., and reading all that certainly sounds like a decision. But what happened was that the court remanded the case back down to the Circuit, where nobody showed up to argue it for the petitioners (Miller and Layton). Thus, the end result was a default ruling upholding NFA. And that’s where it ended. It’s arguable, I suppose, that SCOTUS upheld NFA, but IMHO it’s a weak argument.

    • P.S. – not gonna run right out and buy a “machine gun” !

      Can’t afford the ammo, .50 cal is expensive !!

      • The gun in this case was a Glock with a glock switch converting it, technically, to a machine pistol.
        So its the same ammo, and same gun you already own, you are now (presuming its not overturned) allowed to buy a glock switch and turn it into an automatic pistol.

    • All arms and armament restriction laws are unconstitutional.

      Especially if you use the ‘weapons of war’ clause of the 1934 NFA.

      Want brass knuckles? They have been used in war since pretty much day 1 of fighting.

      Short barreled rifles or pistols with shoulder braces or sawed-off shotguns? All used in wars as soon as they were invented.

      Armor? Cannon? Armed ships or wagons or fortifications? All perfectly constitutional.

      Murder, though, has always been illegal.

  2. What is this “Constitution” you speak of? Pardon me if I don’t hold my breath waiting for the Govenment to start following the so called “Constitution”. If there was anything left of the Constitution it died the day the FBI shot Vicki Weaver in the face.

  3. Well…this is an unlikely (though appropriate) ruling.
    Wasn’t too hard to get all the parts for AR conversion back in the late 1970’s, but I’ll bet all those parts have been hoovered up by now. I should have hoovered some up, but wasn’t interested back then. There’s just a shit-ton of things I shoulda, woulda, coulda done back in the hoary past. Now I’m too old, too crippled, too broke. My interests these days leans towards vintage and 22’s.

  4. Just move to Idaho. You can build your own machine guns and suppressors and the feds can lick balls.. State rules and the sheriff backs us up..
